Terms of Service.
These Terms of Service ("Terms") govern your access to and use of the website at videogenai.io and the VideoGenAI product (the "Service"), operated by Halo sp. z o.o., registered at ul. Warszawska 40/2A, 40-008 Katowice, Poland, KRS 0001145505, NIP 9542880835 ("we", "us", or "VideoGenAI"). By creating an account or using the Service you accept these Terms.
1. Accounts
You must be at least 16 years old to use the Service. You are responsible for keeping your credentials confidential and for all activity that happens under your account. Notify us immediately at support@videogenai.io if you suspect your account has been compromised.
2. Credit packs, billing and refunds
The Service is sold as one-time credit packs, not a subscription. Each pack is a single charge, we never auto-renew, never bill on a schedule, and never take a payment from you without an explicit click. When your tokens run low, you may purchase another pack; the decision is always yours.
Tokens from any pack do not expire, including across pack purchases. Tokens are consumed per second of rendered video and are non-refundable once consumed. Unused tokens can be refunded within 14 days of purchase if none of them have been used, pursuant to the EU consumer-rights directive as implemented in Polish law.
Prices and token conversions are displayed at the time of purchase. We may adjust pricing of new packs with notice on this site; existing token balances are honoured at the rate paid. If we introduce an optional auto-refill feature in the future, it will be strictly opt-in and disabled by default.
2a. Payments, payment methods and invoices
Payments are processed by Stripe (Stripe Payments Europe, Limited, Dublin, Ireland), our PCI-DSS Level 1 certified payment processor. By placing an order you also accept Stripe's Checkout Terms and Privacy Policy.
Depending on your region, supported payment methods may include Visa, Mastercard, American Express, BLIK, Apple Pay, Google Pay, Link by Stripe and SEPA bank debit. Card details, BLIK codes and banking credentials are entered on Stripe's hosted checkout page; we never see, transmit or store them. We only receive a transaction identifier, the order outcome, the masked metadata described in our Privacy Policy, and the issued invoice.
All prices are quoted in USD and are exclusive of VAT unless explicitly stated otherwise. Where required by applicable law, VAT is calculated and added at checkout based on the buyer's declared country and tax status (B2C versus B2B with a verified EU VAT number).
At checkout you choose between an individual receipt and a business (B2B) invoice. For B2B, the company name, registered address and tax identifier (NIP/VAT) you enter will appear on the invoice; you are responsible for the accuracy of that information. After every successful payment Stripe issues a receipt and a VAT-compliant invoice (PDF) and emails them to the address you provided; you can also download them from the link on the order-confirmation page. Invoices, once issued, can only be corrected through a formal correction invoice (faktura korygująca) requested at legal@videogenai.io.
Chargebacks and disputes are handled through Stripe's standard process. We reserve the right to suspend access to tokens funded by a payment that is reversed, charged back or otherwise reclaimed by the issuing bank.
3. Your content, your ownership
Subject to payment of applicable fees and compliance with these Terms, you retain full ownership of the inputs you provide (text prompts, reference images, reference clips) and the renders you generate. VideoGenAI grants you a perpetual, worldwide, royalty- free commercial license to use, modify, distribute and monetise every render you generate on any plan.
4. Licence you grant us
You grant us a limited, non-exclusive, worldwide licence to host, process and transmit your inputs and outputs solely to operate, secure and improve the Service. We do not train our foundation models on your inputs. Aggregate, anonymised usage metrics may be used to improve routing, scheduling and pricing.
5. Acceptable use
You must comply with our Acceptable Use Policy. In particular, you may not use the Service to generate content that sexualises minors, impersonates real individuals without consent, depicts real people in misleading political contexts, or infringes intellectual property you don't own.
6. Service availability
We aim for high availability and publish status incidents publicly. The Service is provided on an "as available" basis; we do not currently offer a contractual uptime SLA.
7. Suspension and termination
We may suspend or terminate your account if you materially breach these Terms or applicable law. You may cancel at any time; unused tokens remain usable until consumed unless your account is terminated for breach.
8. Disclaimers
Generative output can be unpredictable. We do not guarantee any specific result, nor that outputs are free of pre-existing third- party rights. You are responsible for reviewing outputs before publication.
9. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising out of or in connection with the Service is limited to the greater of (a) the total fees you paid in the 12 months preceding the event giving rise to the claim, or (b) EUR 100. We are not liable for indirect, incidental, special or consequential damages. Nothing in these Terms limits liability that cannot be excluded under Polish mandatory consumer law.
10. Governing law & jurisdiction
These Terms are governed by the laws of the Republic of Poland. Disputes are subject to the exclusive jurisdiction of the common courts competent for the seat of Halo sp. z o.o. (Katowice), except where mandatory consumer protection law provides otherwise.
11. Changes
We may update these Terms. Material changes take effect 30 days after we post the revised version or notify you by email, whichever is earlier. Your continued use after that date constitutes acceptance.
